DECISION & ORDER ON MOTION

Motion by the appellant pro se for leave to renew his motion for leave to prosecute an appeal from a judgment of the Supreme Court, Kings County, rendered May 16, 1997, as a poor person, and for the assignment of counsel. Motion by the respondent to dismiss the appeal as abandoned.

Upon the papers filed in support of the motions, and the papers filed in opposition thereto, it is

ORDERED that the motion by the appellant is denied; and it is further,

ORDERED that the motion by the respondent is granted and the appeal is dismissed (see 22 NYCRR 670.8[f]; CPL 470.60[1]).
