ORDERED that the decision and order on application of this court dated April 11, 2008, in the above-entitled case, which granted a motion by the appellant, on an appeal from a judgment of the Supreme Court, Queens County, dated December 18, 2006, is amended by deleting from the preamble thereof the words "Steven Banks, Esq., The Legal Aid Society," and substituting therefor the words "Lynn W. L. Fahey, Esq., Appellate Advocates,".
