DECISION & ORDER ON MOTION

Motion by the appellant pro se on an appeal from a judgment of the Supreme Court, Kings County, rendered May 12, 2005, to be provided with (1) the transcripts of the pretrial proceedings, (2) copies of the papers filed in support of his omnibus motion as well as the order deciding the omnibus motion, and (3) "the purported waiver, executed during trial, prior to the Court's charge to the jury".

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the branch of the motion which is to be provided with the transcripts of the pretrial proceedings is denied without prejudice to renew upon papers indicating the dates on which the pretrial proceedings were conducted; and it is further,

ORDERED that the branch of the motion which is to be provided with copies of the papers filed in support of the appellant's omnibus motion as well as the order deciding the omnibus motion is denied as academic as the papers have been delivered to the appellant; and it is further,

ORDERED that the branch of the motion which is to be provided with "the purported waiver, executed during trial, prior to the Court's charge to the jury" is denied.
