It is Ordered that the motion for a stay is granted on the condition that the appellant perfect the appeal for the September 2008 term of this court - the filing deadline is July 9, 2008. Accruing use and occupancy is to be tendered, without prejudice, to either the landlord or their attorney's office. In the event of appellant's failure to comply with the foregoing conditions, the petitioner-landlord may move on five days' notice for an order vacating the stay.
