DECISION & ORDER ON MOTION

Motion by the County of Orange on an appeal and cross appeal from an order of the Supreme Court, Orange County, dated September 5, 2007, to enlarge the time to perfect its cross appeal and "to decouple" its cross appeal from the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that on the court's own motion, the cross appeal is dismissed as no appeal lies as of right from the order dated September 5, 2007, to the extent that it relates to the proceeding pursuant to CPLR article 78; and it is further,

ORDERED that the motion is denied as academic.
