DECISION & ORDER ON MOTION

On the Court's own motion, it is

ORDERED that its decision and order on motion dated April 11, 2008, in the above-entitled matter, which granted in part and denied in part the appellant's motion for poor person relieve and the assignment of counsel, on an appeal from a judgment of the Supreme Court, Suffolk County, entered January 24, 2007, is amended by deleting from the first paragraph thereof the words "as a poor person and to enlarge the time to perfect the appeal," and substituting therefore the words "as a poor person, for the assignment of counsel, and to enlarge the time to perfect the appeal," and by deleting from the second decretal paragraph thereof the words "the branches of the motion which are to waive the filing fee and for free transcripts are denied," and substituting therefore the words "the branches of the motion which are to waive the filing fee, for free transcripts, and for the assignment of counsel are denied".
