Appeal by Andrew Hochfelder from from an order of the Supreme Court, Nassau County, entered December 6, 2007. By decision and oder on motion dated February 13, 2008, as amended by decision and order on application dated March 14, 2008, the trial of the above-entitled action was stayed pending hearing and determination of the appeal, on condition that the appeal was perfected on or before April 4, 2008. The appeal has not been perfected.
On the court's own motion, it is
ORDERED that the stay granted by the decision and order on motion dated February 13, 2008, is vacated forthwith.
