| ECISION & ORDER ON MOTION |
Motion by the American Nurses Association and the New York State Nurses Association for leave to file an amicus curiae memorandum on a proceeding pursuant to CPLR article 78 in the nature of prohibition to prohibit the respondent from proceeding with an action entitled People v Vinluan, Jacinto, Anilao, Avila, Dela Cruz, Gamiao, Lampa, Maulion, Millena, Ramos, and Sichon, pending in the Supreme Court, Suffolk County, under Indictment No. 769A-K-2007.
Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that the amicus curiae memorandum annexed to the motion papers is accepted for filing; and it is further,
ORDERED that no oral argument by the amicus curiae shall be permitted; and it is further,
ORDERED that on or before May 5, 2008, the parties, if they be so advised, may file reply memoranda to the amicus curiae memorandum.
