| DECISION & ORDER ON MOTION |
Motion by the Port Authority of New York and New Jersey to vacate an interlocutory judgment of the Supreme Court, Queens County, entered December 12, 2006, which was entered pursuant to a decision and order of this court dated November 21, 2006, which reversed an order of the Supreme Court, Queens County, dated January 9, 2006.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is held in abeyance and referred to the panel of Justices hearing an appeal from an order of the Supreme Court, Queens County, dated October 2, 2007 (Appellate Division Docket No. 2007-10480), which denied the movant's motion to vacate the interlocutory judgment entered December 12, 2006, for determination upon the argument or submission of the appeal from the order dated October 2, 2007.
