In the Matter of Pamela Grace Demian, respondent,

v Stratos George Kantounis, appellant.

(Docket No. U-2725-07)

DECISION & ORDER ON MOTION

Motion by the appellant to consolidate appeals from two orders of the Family Court, Nassau County, dated November 16, 2007, and January 10, 2008, respectively, and to enlarge the time to perfect the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the court's own motion, the notices of appeal are treated as applications for leave to appeal from the orders dated November 16, 2007, and January 10, 2008, and leave to appeal is granted (see Family Ct Act § 1112; CPLR 5701[c]); and it is further,

ORDERED that the branch of the motion which is to consolidate the appeals is denied as unnecessary as the appeals may be consolidated as of right (see 22 NYCRR 670.7[c][1]); and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeals is granted, and the appellant's time to perfect the appeals by causing the original papers constituting the record on the appeals to be filed in the office of the Clerk of this court (see 22 NYCRR 670.9[d][2]) and by serving and filing his brief on the appeals is enlarged until June 27, 2008, without prejudice to withdrawing the appeals and raising any issues regarding the orders dated November 16, 2007, and January 10, 2008, respectively, on an appeal from a final order of support; and it is further,

ORDERED that no further enlargement of time shall be granted.

RIVERA, J.P., RITTER, ANGIOLILLO and McCARTHY, JJ., concur.
