ORDERED that its decision and order on motion dated November 9, 2007, in the above-entitled matter, which granted a motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Queens County, is amended by deleting from the caption thereof Indictment Number "02122/06" and substituting therefor Indictment Number "833/04".
