DECISION & ORDER ON MOTION

Motion by the defendants for leave to appeal to this court from two orders of the Supreme Court, Nassau County, dated January 25, 2008, and February 6, 2008, respectively, and two orders of the same court both dated March 13, 2008, and to stay the foreclosure sale of the subject premises pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the branch of the motion which is to stay the foreclosure sale is denied as academic.
