| DECISION & ORDER ON MOTION |
By decision and order on motion of this court dated February 8, 2008, the petitioner's motion to confirm the report of the Special Referee which sustained the charge of professional misconduct was held in abeyance pending receipt of a report from a qualified medical expert assigned to examine the respondent to determine whether he is incapacitated from continuing to practice law. By decision and order on motion of this court dated March 9, 2007, the respondent was immediately suspended from the practice of law pursuant to 22 NYCRR 691.4(l)(1)(i), upon a finding that he was guilty of professional misconduct immediately threatening the public interest in that he failed to submit an answer to a complaint as directed and failed to comply with numerous lawful demands of the Grievance Committee in connection with its investigation; the Grievance Committee was authorized to institute and prosecute a disciplinary proceeding against respondent; and the issues raised were referred to the Honorable John A. Monteleone, as Special Referee to hear and report. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Third Judicial Department on June 23, 1964, under the name Warren Alan Cohen.
Upon the report of Azariah Eshkenazi, M.D., dated March 4, 2008, it is
ORDERED that the respondent is suspended pursuant to 22 NYCRR 691.13(b)(1), until further order of the court, on the ground that he is incapacitated from continuing to practice law and the pending disciplinary proceedings against the respondent shall continue to be held in abeyance.
