DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on July 22, 1987. By decision and order on motion of this court dated June 3, 2005, he was immediately suspended pursuant to Judiciary Law §90(4)(f), the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against him, and the issues raised were referred to the Honorable Lawrence J. Bracken, as Special Referee to hear and report. By further decision and order on motion dated June 29, 2005, the respondent's motion to stay enforcement of that order was granted to the extent that the effective date of the suspension was extended to July 22, 2005. By opinion and order of this court dated September 12, 2006, the respondent was suspended from the practice of law for a period of two years based on his conviction of a serious crime. He was credited for time elapsed under the period of his interim suspension, which effectively commenced on July 22, 2005. By decision and order on motion of this court dated November 7, 2007, the respondent 's application for reinstatement was held in abeyance and the matter was referred to the Committee on Character and Fitness to investigate and report on his current fitness to be an attorney.

Upon the report of the Committee on Character and Fitness and the exhibits annexed thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that, effective immediately, the respondent, Kevin R. Gorry, is reinstated as an attorney and counselor-at-law and the Clerk of the court is directed to restore the name of Kevin R. Gorry to the roll of attorneys and counselors-at-law.
