DECISION & ORDER ON MOTION

Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the Supreme Court, Queens County, rendered October 12, 2006, and for the assignment of new counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on or before June 20, 2008, the appellant shall complete, sign, and return the "risk election" form sent by assigned counsel; and it is further,

ORDERED that if the appellant fails to comply with the above directive then assigned counsel may move to be relieved.
