| DECISION & ORDER ON MOTION |
Motion by the respondents Antonio L. Bustamante and County of Suffolk to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated March 6, 2007, on the ground that the record on appeal is inadequate or for leave to file a supplemental record containing a complete copy of the transcript of the deposition of Antonio L. Bustamante.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied; and it is further,
ORDERED that the branch of the motion which is for leave to file a supplemental record is granted and on or before May 26, 2008, the respondents Antonio L. Bustamante and County of Suffolk shall serve and file a supplemental record containing a complete copy of the transcript of the EBT of Antonio L. Bustamante.
