| DECISION & ORDER ON MOTION |
Motion by the respondents for a preference in the calendaring of an appeal from an order of the Supreme Court, Suffolk County, dated January 17, 2008. Cross motion by the appellants to stay the trial in the above-entitled action pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the cross motion, the papers filed in relation to the motion for a preference, and the papers filed in opposition to the cross motion for a stay, it is
ORDERED that the motion for a preference is denied as academic as the appeal was calendared for May 16, 2008; and it is further,
ORDERED that the cross motion is denied.
