DECISION & ORDER ON MOTION

Motion by the appellant for leave to appeal to the Court of Appeals from an opinion and order of this court dated October 30, 2007, which determined appeals from two orders of the Supreme Court, Suffolk County, dated March 21, 2006, and August 9, 2006, respectively.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, and the following question is certified to the Court of Appeals: Was the opinion and order of this court dated October 30, 2007, properly made?
