SANTINI, RESPONDENT-RESPONDENT. MATTER OF CARL A. GUTZMER, PETITIONER-APPELLANT, V MYRIAM L. SANTINI,
RESPONDENT-RESPONDENT. |
Petitioner-appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Family Court, Genesee County, entered in the Office of the Clerk of said Court on July 24, 2007, and October 22, 2007, and to consolidate the appeals,
Now, upon reading and filing the affirmation of Charles J. Greenberg, Esq., dated April 16, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension
of time to perfect the appeal taken from the order entered July 24, 2007
(CAF 07-02724) is granted and petitioner-appellant shall file the original stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before June 27, 2008, and in the event of failure to so perfect the appeal is hereby dismissed without further order, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal taken from the order entered October 22, 2007
(CAF 07-02722) is denied and the appeal is dismissed on the ground that no appeal lies from an order entered upon consent (see Matter of Cherilyn P., 192 AD2d 1084, lv denied 82 NY2d 652), and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals is dismissed.
