Appellant having moved to expedite oral argument of the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Oneida on
August 21, 2006, September 14, 2006, and June 5, 2007, and for an extension of time to perfect appeals from orders of the same court entered July 3, 2007 and September 26, 2007, and respondents having cross-moved to dismiss those two appeals for failure to perfect timely,
Now, upon reading and filing the affidavit of Margaret Zavalidroga sworn to March 27, 2008, the notice of motion with proof of service thereof, the opposing affirmation of Gregory J. Amoroso dated April 2, 2008, the notice of cross motion with proof of service thereof, the reply statement of Margaret Zavalidroga dated April 3, 2008, and due deliberation having been had thereon,
It is hereby ORDERED that the motion and cross motion be, and the same hereby are, granted to the extent that appellant shall perfect the appeals from the orders entered July 3, 2007 and September 26, 2007 (Docket Nos. CA 08-00724 and CA 08-00725) on or before July 14, 2008 and, in the event of failure to so perfect, the appeals are hereby dismissed without further order, and the motion is otherwise denied.
