Now, upon reading and filing the statement of Kenneth Barksdale, dated April 9, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion for an extension of time is granted on the condition that appellant perfect the appeal on or before August 19, 2008, and in the event of failure to so perfect, the appeal is hereby dismissed without further order, and
It is further ORDERED that the appeal herein may be prosecuted upon one record as defined by 22 NYCRR 1000.3(c)(1) and ten copies of appellant's brief, reproduced in accordance with 22 NYCRR 1000.4(f),
