It is hereby ORDERED that the motion be, and the same hereby is, denied.
Memorandum: Venue belongs in this Court pursuant to Court of Claims Act § 24 because the claim arose within the Fourth Department. There is no need for claimant to appear when he can submit his appeal without oral argument.
