| DECISION & ORDER ON MOTION |
Motion by the appellant for a preference in the calendaring of appeals from three orders of the Supreme Court, Suffolk County, dated October 31, 2007, December 10, 2007, and January 15, 2008, respectively. Cross motion by the respondent to enlarge the time to serve and file a brief and pursuant to 22 NYCRR 670.8(d)(2) for an award of costs and an attorney's fee.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the branch of the cross motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until June 13, 2008, and the respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the branch of the cross motion which is pursuant to 22 NYCRR 670.8(d)(2) for an award of costs and an attorney's fee is denied.
