| DECISION & ORDER ON MOTION |
Motion by the respondent on appeals from three orders of the Supreme Court, Nassau County, dated August 30, 2007, September 11, 2007, and October 12, 2007, respectively, for leave to serve and file a supplemental record containing an affidavit of Lawrence A. Cline, dated April 6, 2007. By decision and order on motion of this court dated March 6, 2008, the matter was remitted to the Supreme Court, Nassau County, for a report, and the motion was held in abeyance in the interim. The Supreme Court, Nassau County, has filed its report.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the report of the Supreme Court, Nassau County, dated May 6, 2008, and the papers filed in connection thereto, it is
ORDERED that the motion is granted, and on or before June 9, 2008, the respondent shall serve and file a supplemental record containing the affidavit of Lawrence A. Cline, dated April 6, 2007.
