DECISION & ORDER ON MOTION

Motion by the appellant to stay all proceedings in the above-entitled action pending hearing and determination of an appeal from an order of the Family Court, Suffolk County, dated May 1, 2008, or, in the alternative, to stay enforcement of the conditions of probation added May 5, 2008, which stated "no curfew, [the appellant] must appear in court daily after school, then [go] home after court" and placed the appellant on "electronic monitor[ing]."

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that enforcement of the conditions of probation added May 5, 2008, which stated "no curfew, [the appellant] must appear in court daily after school, then [go] home after court" and placed the appellant on "electronic monitor[ing]" are stayed pending hearing and determination of the appeal, and the motion is otherwise denied.
