Appeal by the defendant from a judgment of the Supreme Court, Kings County, rendered November 7, 2005. The court has been advised that the appellant died on July 26, 2007.
Now, on the court's own motion, it is
ORDERED that the appeal is dismissed, and the matter is remitted to the Supreme Court, Kings County, for entry of an order vacating the judgment and dismissing the indictment pursuant to People v Mintz (see 20 NY2d 770).
