ECISION & ORDER ON MOTION

Motion by the petitioner for summary judgment in a proceeding pursuant to CPLR article 78, inter alia, in the nature of mandamus and prohibition, among other things, to annul certain determinations of the Appellate Term, Second and Eleventh Judicial Districts.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as academic in light of our determination of the proceeding (see Matter of Toriola v Supreme Court State of New York, AD3d [2d Dept, May 20, 2008]).
