Now, upon reading and filing the affidavit of Pandora Leak, sworn to April 23, 2008, the notice of motion with proof of service thereof, the letter of J. Michael Marion, dated May 1, 2008, the letter of Frank Bogulski, dated May 23, 2008, the letter of Joseph Muscato, dated May 29, 2008, and due deliberation having been had thereon,
