Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Suffolk County, dated January 10, 2008, on the ground that the notice of appeal was not timely served.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the time to serve the notice of appeal, which was timely filed, is extended until July 7, 2008 (see CPLR 5520[a]); and it is further,
ORDERED that the motion is denied.
