| DECISION & ORDER ON MOTION |
Motion by the petitioner, inter alia, to dismiss a proceeding pursuant to CPLR article 78 which was transferred to this court by order of the Supreme Court, Nassau County, entered November 2, 2007, for failure to timely perfect.
Upon the papers filed in support of the motion and the papers filed in opposition or relation thereto, it is
ORDERED that the motion is denied, and it is further,
ORDERED that on the court's own motion, the petitioner's time to perfect the proceeding is enlarged until July 25, 2008, and the petitioner's record or appendix and brief must be served and filed on or before that date; and it is further,
ORDERED that no further enlargement of time shall be granted.
