Now, upon reading and filing the affirmation of Charles J. Greenberg, dated May 12, 2008, the notice of motion with proof of service thereof, and there being no opposition thereto,
It is hereby ORDERED that the motion be and the same hereby is granted, and the appeal is dismissed, and
It is further ORDERED that the order of this Court entered December 6, 2007 assigning Charles J. Greenberg to perfect the appeal is vacated.
