DECISION & ORDER ON MOTION

Motion by the City of Long Beach for leave to appeal to this court from two orders of the Supreme Court, Nassau County, dated February 23, 2008, and April 3, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the order dated February 23, 2007, is denied on the ground that the motion for leave to appeal was untimely (see CPLR 5513[b]); and it is further,

ORDERED that the branch of the motion which is for leave to appeal from the order dated April 3, 2008, is denied.
