DECISION & ORDER ON MOTION

Motion by the Natasha De Gannes Gamble for leave to appeal to this court from an order of the Family Court, Kings County, dated June 6, 2008, to stay enforcement of so much of the order as awarded temporary custody of the subject child to the father and for the return of the child, pending hearing and determination of the appeal, and for leave to prosecute the appeal as a poor person.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the branches of the motion which are to stay enforcement of so much of the order as awarded temporary custody of the subject child to the father and for the return of the child, pending hearing and determination of the appeal, and for leave to prosecute the appeal as a poor person are denied as academic.
