DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated June 26, 2007, to reconstruct the record and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to reconstruct the record is granted to the extent that the matter is remitted to the Supreme Court, Kings County, to settle the record and to issue a report setting forth the papers which constitute the record on appeal; the Supreme Court, Kings County, shall issue its report with all convenient speed; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is held in abeyance in the interim.
