| DECISION & ORDER ON MOTION |
Appeal by Delanda R. from an order of the Family Court, Kings County, dated January 30, 2008. By order to show cause dated June 4, 2008, the parties or their attorneys were directed to show cause why an order should or should not be made and entered dismissing the appeal in the above-entitled proceeding for failure to comply with a scheduling order dated February 25, 2008, issued pursuant to 22 NYCRR 670.4(a)(2). Application by the appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel.
Now on the court's own motion, and the papers filed in opposition or relation thereto, and upon the application, it is
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that the application for leave to prosecute the appeal as a poor person and for the assignment of counsel is denied with leave to renew, on or before July 11, 2008, upon proper motion papers establishing that the appellant is entitled to poor person relief, including information regarding her income, assets, and expenses.
