ECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this court dated April 28, 2003 (People v Harris, 304 AD2d 839), which determined an appeal from a judgment of the Supreme Court, Kings County, rendered April 24, 2000, which was determined by decision and order of this court dated February 7, 2005.

Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is

ORDERED that the motion is denied.
