| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated May 1, 2008, to extend the duration of a notice of pendency filed on May 23, 2005, and thereafter extended through July 23, 2008.
Upon the papers filed in support of the motion and upon the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the period of the duration of the notice of pendency filed in the Office of the Clerk of the County of Kings on May 23, 2005, and extended by order of the Supreme Court, Kings County, dated May 1, 2008, through July 23, 2008, is further extended for an additional period of three years through July 23, 2011, or until further order of this court; and it is further,
ORDERED that this extension order shall be filed, recorded, and indexed in the manner prescribed by CPLR article 65 against the property located at 1020-1032 Atlantic Avenue, County of Kings, State of New York, prior to the expiration of the notice of pendency filed on May 23, 2005, and extended on May 1, 2008.
