It is Ordered that the motion is granted to the extent of staying the re-execution of the warrant of eviction until after August 14, 2008. If, by said date, the appeal has been perfected for the October 2008 term and the July and August use and occupancy has been tendered to the petitioner, without prejudice, then the appellant may apply for a continuation of the stay. Otherwise, the warrant of eviction may be re-executed after August 14, 2008. The appeal may proceed on the original record of the trial court.
