DECISION & ORDER ON MOTION
FOR REINSTATEMENT

Motion by the respondent for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on February 2, 1981. By decision and order on motion of this court dated January 27, 1998, he was suspended from the practice of law pursuant to 22 NYCRR 691.4(l)(1)(iii), upon a finding that he was guilty of professional misconduct immediately threatening the public interest based on uncontroverted evidence of such professional misconduct, and the issues raised were referred to the Honorable Theodore Kupferman, as Special Referee to hear and report. By opinion and order of this court dated July 10, 2000, the respondent was disbarred, effective immediately.

Upon the papers submitted in support of the motion and the papers submitted in relation thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to practice law.
