DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue his application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated March 3, 2003 (People v Mitchell, 303 AD2d 422), affirming a judgment of the County Court, Suffolk County, rendered August 23, 2001, which was determined by decision and order on motion dated March 25, 2008.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
