ORDER ON APPLICATION

Application by the appellants-respondents pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated July 17, 2007, and cross application by the respondents-appellants for the same relief.

ORDERED that the application and cross application are granted; and it is further,

ORDERED that the appellants-respondents' time to perfect the appeal is enlarged until August 19, 2008, and the joint record or appendix on appeal (see 22 NYCRR 670.8[c][1]) and the appellants-respondents' brief must be served and filed on or before that date; and it is further,

ORDERED that the third-party defendants respondents-appellants shall serve and file their answering brief, including their points of argument on their cross appeal, on or before September 24, 2008 (see 22 NYCRR 670.8[c][3]); and it is further,

ORDERED that the plaintiff-respondent-appellant shall serve and file his answering brief, including his points of argument on his cross appeal, on or before October 29, 2008 (see 22 NYCRR 670.8[c][3]); and it is further,

ORDERED that the appellants-respondents shall serve and file their reply brief on or before December 4, 2008; the third-party defendants respondents-appellants and the plaintiff -respondent-appellant shall serve and file their respective reply briefs on or before December 19, 2008.
