DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect an appeal from an order of the Supreme Court, Westchester County, dated November 9, 2007.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appellant's time to perfect the appeal is enlarged until August 21, 2008, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.

We note that the appellant may perfect the appeal upon a stipulation as to the contents of the record or the appellant can move to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the record or appendix on appeal at the time he perfects the appeal.
