Now, upon reading and filing the affidavit of Thomas S. Wiswall sworn to June 13, 2008, the notice of motion with proof of service thereof, the affirmation of Andrew B. Ayers dated June 18, 2008, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be, and the same hereby is, granted and respondent-appellant shall perfect the cross appeal on or before July 30, 2008 and, in the event of failure to so perfect, the cross appeal is hereby dismissed without further order.
