Appellant having moved to consolidate the appeal taken from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Onondaga, on January 25, 2007 (KA 07-01179), with an application pursuant to CPL 460.15 seeking permission to appeal from an order of Supreme Court entered in the Office of the Clerk of the County of Onondaga, on May 23, 2008 (KA 08-01258),
Now, upon reading and filing the affidavit of Maurice Delee, sworn to June 9, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
