Respondent-appellant having moved for an extension of time to perfect the cross appeal taken from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on April 11, 2007, and to file and serve the responding brief,
Now, upon reading and filing the affidavit of Kimberly A. Colaiacovo sworn to June 16, 2008, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion be, and the same hereby is, granted to the extent that the second ordering paragraph of the order of this Court entered May 12, 2008 is hereby amended by deleting the date June 27, 2008 and inserting in its place the date July 28, 2008, and
It is further ORDERED that reply briefs, if any, shall be filed and served on or before August 12, 2008.
