| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, for leave to withdraw the brief previously filed and file a replacement brief on an appeal from a judgment of the Supreme Court, Kings County, rendered June 20, 2006.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that appellant's brief is deemed withdrawn and on or before August 18, 2008, the appellant shall serve and file a replacement brief; and it is further,
ORDERED that on or before October 17, 2008, the respondent shall serve and file a brief; and it is further,
ORDERED that the motion is otherwise denied.
