Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Orange County, dated May 13, 2008, on the ground that a default judgment has been entered in the action.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the court's own motion, the motion and the appeal are held in abeyance pending determination of the appellant's motion to vacate his default; the parties shall advise the court when the appellant's motion to vacate his default is determined.
