DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Queens County, dated September 25, 2007, to enlarge the record to include the papers submitted in connection with his motion for leave to serve an amended bill of particulars in the above-entitled action, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the record is enlarged to include the papers submitted in connection with the appellant's motion for leave to serve an amended bill of particulars in the above-entitled action, which are annexed to the papers filed in support of the motion to enlarge the record on appeal as Exhibit B; and it is further,

ORDERED that the appellant's time to perfect the appeal is enlarged until July 24, 2008, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
