DECISION & ORDER ON MOTION

Motion by Stephen J. Pittari, Esq., counsel assigned to prosecute an appeal from a judgment of the County Court, Westchester County, rendered May 1, 2007, to be relieved on the ground that the appellant has, in effect, abandoned the appeal, by failing to respond to correspondence sent to him by assigned counsel. Cross motion by the respondent to dismiss the appeal as abandoned.

Upon the papers filed in support of the motions, and the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and assigned counsel is relieved; and it is further,

ORDERED that the cross motion is granted and the appeal is dismissed.
