DECISION Motion by appellant seeking to stay sentence, including 3 years' probation with 30 days' incarceration, pending determination of the appeal is granted on consent to the extent that the portion of the sentence imposing incarceration is stayed, on condition that the appeal be perfected by October 3, 2008 and bail in the amount of $1,500 is deposited in the court below within 10 days of the date of the order hereon.
In the event that the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on 3 days' notice.
